Anak Nunjiz Establishment - Version 2.0
Preamble
"Anak" Establishment provides an electronic platform that acts as an intermediary for vehicle maintenance services. We pick up the vehicle from the customer, transport it to authorized maintenance centers, supervise the inspection and repair process, and then return it to the customer. The platform also provides supporting digital services including AI-powered smart diagnostics, an appointment system, a loyalty program, price comparison, and a digital car logbook.
Your use of our services constitutes explicit and full acceptance of all terms of this agreement.
Article 1: Definitions
- Platform: The website, application, or social media platforms owned by the Establishment through which services are requested.
- Services: All work provided by the Establishment, including but not limited to: vehicle transport, inspection, cost estimation, parts supply, repair, and delivery.
- Service Provider: Maintenance centers, workshops, or individuals contracted by the Establishment to perform inspection and repair work.
- Inspection Report: The document detailing the vehicle's condition and faults discovered after technical inspection.
- Quotation: The document detailing proposed repair costs, including parts prices and labor.
- Warranty Period: The duration during which the Establishment guarantees the quality of the repair performed on the specified fault.
- Account: The electronic account registered in the customer's name on the platform.
- Smart Diagnostics: A technology service relying on artificial intelligence to provide preliminary, indicative estimates of vehicle faults.
- Loyalty Program: A rewards system that allows customers to earn points and redeem them for discounts.
- Loyalty Points: Digital units granted to the customer as a reward; they have no independent monetary value.
- Appointment: The specified time slot reserved by the customer through the platform to receive a service.
- Review: The rating and feedback provided by the customer after service completion.
- Digital Car Logbook: An electronic record containing the vehicle's maintenance history and services provided through the Establishment.
- Price Comparison: An indicative tool to display and compare parts and service prices.
Article 2: Service Scope and Stages
The Establishment is committed to providing services according to the following stages:
- Service Request: The customer requests a service and specifies their location through the platform. They may use Smart Diagnostics and book an appointment.
- Vehicle Pickup: The vehicle is picked up from the customer's location by an authorized transporter.
- Inspection and Reporting: The vehicle is inspected at an authorized maintenance center and a detailed inspection report is prepared.
- Quotation: A quotation is sent to the customer based on the inspection report.
- Repair Approval: The customer must approve the quotation to proceed.
- Repair Execution: After approval, repair work and parts procurement begin.
- Payment: The customer pays the full due amount after the repair is complete and before delivery.
- Vehicle Delivery: The vehicle is delivered to the customer at the agreed location.
Article 3: Customer Obligations and Acknowledgments
By accepting this agreement, you acknowledge and undertake the following:
- Legal Capacity: You have full capacity to enter into contracts.
- Information Accuracy: Provide correct, accurate and complete information and update it when needed.
- Lawful Use: Use the services for lawful purposes only.
- Cooperation: Respond to the Establishment's team in a timely manner.
- Personal Belongings: Remove all personal and valuable items from the vehicle before handover.
- Identity Proof: Provide proof of identity or vehicle ownership if requested.
- Honest Reviews: Commit to providing honest, objective reviews.
- Fair Use of Loyalty Program: No manipulation or unlawful exploitation of the loyalty program.
Article 4: Pricing, Payment and Refunds
- Quotation: An initial quotation is issued after inspection.
- Additional Faults: If additional faults are found, you will be notified immediately and an updated quotation issued.
- Payment: The full final invoice must be paid before vehicle delivery.
- Invoices: All invoices are issued under the name "Anak Nunjiz Establishment".
- Cancellation Policy:
- The customer may cancel a service request within one hour of submission without any fees.
- If a transporter is assigned and en route, an administrative fee of SAR 100 applies.
- If cancelled after vehicle pickup, the customer covers actual transport costs.
- If the customer is unresponsive or the vehicle is not present, an administrative fee of SAR 100 applies.
- Quotation Rejection: The vehicle is returned with the customer paying inspection and transport costs only.
- Refunds: Refunds are processed within 10 to 45 business days.
Article 5: Warranty
- Warranty Scope: Covers the quality of labor on completed repairs only, plus the warranty on new parts.
- Warranty Duration: Varies by repair type and is specified on the final invoice.
- Warranty Exclusions: Faults from misuse, partial repairs against recommendation, and faults in unrepaired parts.
- Warranty Procedures: Contact the Establishment directly to inspect the vehicle and determine the cause.
Article 6: Limitations of Liability
- Start and End of Liability: From the moment of vehicle pickup until delivery and signing of the receipt form.
- Insurance: All vehicles are covered by an insurance policy while in the Establishment's custody.
- Parts Delays: The Establishment is not liable for compensatory costs due to delays beyond its control.
- Non-Response: The Establishment may halt work and return the vehicle after 5 business days of non-response.
- Force Majeure: No party is liable for delays due to circumstances beyond control.
- Smart Diagnostics: Results are preliminary, indicative estimates only and not certified technical reports.
- Price Comparison: Displayed prices are indicative and may differ from actual prices.
- Digital Car Logbook: Not considered an official document of vehicle condition.
Article 7: Confidentiality and Data Protection
- Compliance: We comply with the Saudi Personal Data Protection Law (PDPL).
- Purpose of Collection: To provide and improve the service and communicate with you only.
- Data Sharing: Only as needed to deliver the service, with parties bound by confidentiality.
- Notifications: You agree to receive notifications related to your requests and appointments.
- Retention Period: For the duration of your account activity and for no more than 3 years after the last interaction.
- Your Rights: Access your data, correct it, request deletion, or obtain an electronic copy.
- Account Confidentiality: You are responsible for keeping your account information confidential.
- Non-Disclosure: We commit to not disclosing the identities of service providers.
Article 8: Electronic Account
- The customer may register only one account with correct information.
- The Establishment may suspend or cancel the customer's account in case of violation.
- The customer is responsible for all operations through their account.
- Account deletion can be requested via the platform.
Article 9: Smart Diagnostics
- A service that relies on AI to provide preliminary estimates.
- Results are indicative estimates only and not a substitute for technical inspection.
- The Establishment is not liable for decisions based on Smart Diagnostics alone.
- Estimated costs are subject to change.
- A daily usage limit may be applied.
- Diagnostic data may be used to improve the service while preserving confidentiality.
Article 10: Loyalty Program and Points
- Loyalty points are earned by using services.
- Points do not represent monetary value and cannot be transferred or withdrawn.
- Membership tiers offer different benefits with automatic upgrades.
- The Establishment may modify or cancel the program with 30 days' notice.
- Unused points may expire.
- The Establishment may revoke points obtained improperly.
- Closing the account forfeits accumulated points.
Article 11: Appointments
- Appointments are booked through the platform based on availability.
- Cancel or reschedule appointments at least 4 hours in advance without fees.
- No-show without cancellation may incur an administrative fee.
- The Establishment may reschedule for operational reasons with prior notice.
- Appointments depend on actual availability.
Article 12: Reviews and Feedback
- The customer may review the service after completion.
- The Establishment may hide abusive or misleading reviews.
- The Establishment may respond to reviews.
- Published reviews become the platform's property.
- Using reviews as a means of pressure or extortion is prohibited.
Article 13: Digital Car Logbook
- A digital record for each vehicle including maintenance and service history.
- Includes: service log, invoices, inspection reports, and maintenance alerts.
- Data accuracy depends on the information provided.
- The logbook is not an official document.
- The customer may export the logbook electronically.
Article 14: Price Comparison
- A tool for comparing parts and service prices.
- Prices are indicative and subject to change.
- The Establishment is not liable for price inaccuracies.
- Displayed prices are not a binding commitment.
Article 15: Intellectual Property
- All platform content is the exclusive property of the Establishment and is protected by intellectual property laws.
- Copying or reproducing any content without written permission is prohibited.
- Use of the "Anak" name or its logo without official authorization is prohibited.
Article 16: Modification and Termination
- Modification of Terms: You will be notified of material changes 14 days before they take effect. Continued use constitutes acceptance.
- Contract Termination: An open-ended contract that may be terminated by either party at any time.
- Effects of Termination: Outstanding financial obligations remain in force, and the customer forfeits loyalty points.
Article 17: Governing Law and Dispute Resolution
- Governing Law: The laws and regulations of the Kingdom of Saudi Arabia.
- Dispute Resolution: Amicable resolution within 15 days; otherwise, the courts of Riyadh have jurisdiction.
- Communication: Through the channels available on the platform.
Customer Acknowledgment
By creating an account on the platform, I acknowledge that I have read and understood all terms and conditions of this agreement, including the provisions on Smart Diagnostics, the Loyalty Program, Appointments, Reviews, Digital Car Logbook, Price Comparison, and Data Protection, and I agree to fully comply with them.
